Phone & Absentee Bids

  1. Telephone and absentee bid forms must be received 24 hours prior to auction. Bidders are responsible to verify Grant Zahajko Auctions, l.l.c. has received their bidding information.
  2. No telephone bids are accepted for less than $250. Absentee bids accepted for under $250.
  3. Bidders should examine lots offered, or request a condition report, 24 hours prior to the auction.
  4. Bidders agree to accept our auction Terms & Conditions.
  5. Grant Zahajko Auctions, LLC, will make a good faith effort to accommodate bidders but will not be held responsible for errors or telephone disconnection if such occurs. Grant Zahajko Auctions, l.l.c. will call the telephone bidder approximately 5 minutes prior to the auction lot being offered.
  6. Winning bids must be paid in full by no later than 4 days following auction or notification of your winning bid. Items purchased may not be shipped until full payment is made.
  7. Buyer is responsible for all shipping and handling costs. Grant Zahajko Auctions, LLC, will not be held responsible for any loss or damage of goods while in transit.

Terms and Conditions of Auction: Online Bidding

Online Bidding:

All online bidders are required to register with the online platform of their choice. Registration for online bidding follows the rules and requirements set by the platform chosen. In addition to those requirements, these Terms & Conditions apply.

Online Registration Requirements:

Registration online is for a specific auction only. Grant Zahajko Auctions, L.L.C. has the authority to approve or disapprove an individual for bidding at their auction. In addition to the requirements for the specific platform, Grant Zahajko Auctions, L.L.C. will require an individual to submit a valid credit card prior to the auction to be accepted for bidding.

Buyer’s Premium:

A 26% Buyers Premium will be added to all online bids. All bidders agree to accept our Terms & Conditions of Auction when bidding.

Buyer’s Review of Lots:

Bidders should examine all lots – descriptions and photographs prior to bidding as all items are sold as-described/photographed.

Multiple Bidding Platforms:

Grant Zahajko Auctions LLC may place an auction on multiple bidding platforms. The platforms are independent of one another. All bids will be presented to the auctioneer at the time of actual sale. The auctioneer will determine which bid will be taken in the event there is an equal bid on more than one bidding platform. The decision of the Auctioneer shall be final, fixed, and unequivocal.

Bidder Disputes:

If any dispute occurs between two (or more) bidders, the Auctioneer may decide the sale. Or the Auctioneer may put the lot up for sale again and resell to the highest bidder. The decision of the Auctioneer shall be final, fixed, and unequivocal.

Personal and Property Risk:

Persons in attendance during preview, sale, or removal of goods, assume any and all risks of damage of or loss to person and property, and specifically release the Auctioneer from liability therefore. Neither the Auctioneer, Grant Zahajko Auctions, L.L.C., nor their principal, shall be liable in the event of any dispute. The Auctioneer and Grant Zahajko Auctions, L.L.C., may tape record and/or video tape any auction, and the buyer agrees to allow such tape recording and/or video tape to be submitted as evidence in a court of law. Buyers agree to pay all reasonable fees incurred in enforcing these terms.

Payment:

All invoices must be paid in full before their merchandise will be shipped or released to them. The buyer is responsible for paying the seller directly after winning the item. Any invoice totaling over $5,000, or any invoice deemed necessary by GZ Auctions will require a wire transfer. Additionally, any applicable sales tax will be charged, unless a copy of a valid reseller permit or tax exemption is provided.

Live Auctioneers Bidders – Your credit card on file with Live Auctioneers will be charged for the invoice automatically 72 hours after invoices have been sent. If you prefer to pay an alternate method, please call us within 48 hours of receiving your invoice. There is no processing fee for this service.

Invaluable/Auction Zip/Infinite Bidding Bidders – Payment is due within 4 days of the auction thru The Invaluable/Auction Zip automatic payment service. If invoice is not paid your credit card on file will be automatically charged on the 5th day. There is no processing fee for this service.

GZA Platform (Auction Mobility) Bidders – You will receive an invoice to pay after auction. Payment is due within 4 days following the auction. There is no processing fee for this service.

Any invoice not paid within the specified timeframe will be subject to automatic cancellation.

The seller no longer accepts credit cards over the phone. We do not accept PayPal, checks or money orders.

Shipping:

The buyer is responsible for paying all shipping and handling (labor & materials to pack) costs. Our in-house shipping department will gladly pack and ship any item that fits into a 16x16x16 inch or 30x5x24 inch or equivalent or smaller box/folio. We will charge for labor to pack and process based on actual time it takes, actual cost of materials used to pack and actual shipper charges that will include insurance and signature required. We generally use USPS and Fed Ex and compare the pricing between the two. Books maximum box size will be 14x14x14 inch or equivalent and will be shipped USPS Media Mail unless otherwise requested. We gladly will give shipping estimates prior to auction. Please make this request at least 24 hours prior to auction for our shipping department to respond. We will also gladly combine items if they fit into one box and meet our maximum box size stated here. We reserve the right to require an outside shipper on any item(s) in the auction.

If your invoice requires the use of an outside shipper buyer must call for quote. Here are 2 options:

Removal:

Removal shall be at the expense, liability, and risk of the purchaser. Purchases can be removed from premises only upon presentation of a paid invoice. The Auctioneer shall not be responsible for goods not removed/shipped within 30 days and shall have the option of removing and storing at the expense and risk of the purchaser any article purchased.

Any shipping invoice not paid in full within 30-days of auction will be sent to storage at a cost of $25 USD minimum, or 5% of the purchase price per lot (whichever is higher) per month. No property will be released until storage fees are paid in full.

If after 120-days the invoice and storage fee has not been paid in full, the merchandise will be considered abandoned and no refunds will be given.

Non-Delivery Responsibility:

Auctioneer shall not, in any event, be liable for non-removal, or for any other matter or thing, to any purchaser of any lot, other than for the return to the purchaser of the deposit, or sum paid on said lot, should the purchaser be entitled to it.

Claims:

No claims will be allowed after goods are removed from premises by bidder, or after receipt by bidder.

Compliance with the Terms of Sale:

In default of payment of invoices in full within the time specified, the auctioneer, in addition to all other remedies allowed by law, may retain all moneys received as deposit or otherwise as liquidated damages. Lots not paid for and removed within the time specified herein will be considered abandoned no refunds given.

Condition of Items Sold:

Grant Zahajko Auctions LLC may, but shall have no obligation to consider any reasonable request to refund any lot for discrepancy of description. Grant Zahajko Auctions LLC must be notified within 21 days of date of sale of the discrepancy and if Grant Zahajko Auctions agrees to a refund, the lot must be returned to Grant Zahajko Auctions LLC, in same condition it was in at the time of sale, within 30 days of the date of sale. NO refunds will be given after 30 days of date of any sale for any reason.

Addition-To, or Withdrawal-From, Sale:

The Auctioneer reserves the right to withdraw from Auction any of the items listed for sale. The Auctioneer also reserves the right to sell at this Auction items not currently listed. Additionally, the Auctioneer reserves the right to group one or more lots into one or more selling lots or to subdivide lots into two or more selling lots. Whenever the best interest of the seller is served, the auctioneer reserves, when necessary, the right to sell all of the items listed in bulk.

Reserve:

The Auctioneer reserves the right to reject any, and all, bids. On lots with a reserve, the auctioneer has the right to bid on behalf of the seller.

Additional Terms and Conditions:

Any additional terms or conditions of sale or items, added by Auctioneer, shall be announced prior to the Auction and are binding.

Agency:

The Auctioneer is acting as agent only and is not responsible for acts of its principals.

Bidder Responsibilities

In-Person Bidding:

All in-person bidders are required to have a bidder’s number. The bid number for in-person bidding is available at the registration desk. Bidders must show valid photo identification (e.g., Driver’s License) to register. Bidder numbers will be assigned upon completion of registration. The bid card and number is valid for the Specific Auction only!

In-House Absentee and Phone Bidding:

In-House Absentee or Phone bidding forms are available at the registration desk prior to the auction, or online at gzauctions.com. In-House Absentee and Phone bidders can also call or email the auction house prior to the date of the auction to register.

All In-Person, In-House Absentee, and Phone Bidders:

All In-Person, In-House Absentee and Phone bidders should examine all lots offered as all items are sold as-is. A 21% Buyers Premium will be added to all In-Person, In-House Absentee, and Phone bids. Phone bids must be over $250. All bidders agree to accept our Terms & Conditions of Auction when bidding.

Any invoice totaling over $5,000 will require a wire transfer. For In-House Absentee and Phone bidders, payment is due within 4-days following receipt of the invoice. Additionally, any applicable sales tax will be charged, unless a copy of a valid reseller permit or tax exemption is provided. All customs duty and taxes will be paid by buyer.

Any invoice not paid within the specified timeframe will be subject to automatic cancellation.
